If you recently purchased a home in an HOA community, attended a Board meeting, or opened your association’s welcome packet, you may have found yourself looking at several different documents.


The Declaration.


The Articles of Incorporation.


The Bylaws.


Rules and Regulations.


Architectural Standards.


At first glance, it can feel a little overwhelming.


You may wonder:


“What are all these documents?”

“Why does my HOA need so many of them?”

“Do I really need to understand every one?”


They’re fair questions.


Each governing document has a different purpose.


Together, they create the framework that helps the homeowners’ association operate, explains how decisions are made, establishes the rights and responsibilities of homeowners, and provides guidance for everyday community living.


The good news is that you don’t need to memorize every document.


You simply need to understand what each one does and where to look when you have a question.

Why Doesn’t My HOA Have Just One Document?


At first, having several governing documents may seem unnecessary.


After all, wouldn’t it be easier if everything were written in one place?

Perhaps.


But each governing document addresses a different part of how the community is created, governed, and maintained.


Some documents establish property rights and responsibilities.


Others explain how the association operates and how decisions are made.


Some provide rules for everyday community living.


Others establish standards for changes to homes and property.


Rather than expecting one document to answer every question, the governing documents work together to create an organized system for the community.


  

Think of Governing Documents Like a Toolbox


Imagine opening a toolbox.

  

Inside, you don’t find one tool that performs every job.

 

You find a hammer, a screwdriver, a wrench, a tape measure, and many other tools.

 
Each one has a different purpose.

  

You wouldn’t use a hammer to tighten a bolt or a tape measure to drive a nail.


Your HOA’s governing documents work much the same way.


Each document was created to perform a particular job.


The Declaration establishes important property rights, restrictions, and responsibilities.

  • The Articles of Incorporation create the      association as a legal entity.
  • The Bylaws explain how the association is      governed and operated.
  • The Rules and Regulations provide guidance for      everyday community living.
  • The Architectural Standards, when adopted, help      preserve the appearance and character of the community.


Individually, each document answers different questions.


Together, they help the homeowners’ association function as a whole.

Once you understand that every document has a different purpose, it becomes much easier to know where to look when a question arises.


Some documents establish the community.


Some explain how the association operates.


Some define property rights and responsibilities.
