Why My HOA Have Rules?

Before we talk about Rules & Regulations, let's start with one important idea:

Your HOA isn't governed by just one document. Instead, it's governed by several governing documents that work together.

The Declaration is one of those documents, and it's often considered the most important because it establishes the community's basic rights, responsibilities, and restrictions.

So if the Declaration is so important, why do we also need Rules & Regulations?

Imagine trying to operate an entire community using only the Declaration.

Every question about parking, pets, trash collection, pool hours, clubhouse reservations, recreational amenities, or guest parking would have to be included in one document.

That would be nearly impossible.

That's where Rules & Regulations come in.

Here's an easy way to think about it:

The Declaration tells you what.

The Rules tell you how.

The Declaration establishes many of the community's rights and restrictions.

The Rules & Regulations explain how many of those restrictions—and many day-to-day community expectations—are carried out .

For example:

The Declaration tells you what...

Owners have the exclusive right to use an assigned parking space.

The Rules and Regulations tell you how...

Where guests may park, whether a parking decal is required, and how parking is enforced.

The Declaration tells you what...

Owners may use the common recreational amenities

The Rules and Regulations tell you how...

Pool hours, clubhouse reservations, and amenity rules.

The Declaration tells you what... 

Owners may lease their property no more than once every 12 months.

The Rules tell you how... 

When the lease application must be submitted, what documents are required, and the move-in approval process.

Notice the pattern? The Declaration establishes the right or restriction. The Rules explain how that right or restriction works in everyday community living.

Now the purpose of the Rules & Regulations becomes much easier to understand. 

Every community is different, but Rules & Regulations commonly address topics such as:

· Parking

· Pets

· Pool and clubhouse use

· Trash collection

· Recreational amenities

· Guest parking

· Vehicle restrictions

· Leasing procedures

· Other day-to-day community operations

Unlike the Declaration, which often requires a membership vote to amend, Rules & Regulations can frequently be adopted or amended by the Board after following the procedures required by Florida law and the community's governing documents.
 

This allows the Association to respond to changing community needs without having to amend the Declaration.

Rules & Regulations work alongside the Declaration—they do not replace it.
 

As we learned in "Which Document Matters Most?" not all governing documents carry the same weight. That means a Rule generally cannot conflict with or override a restriction contained in the Declaration.

Think of the Rules and Regulations as your guide to everyday community living.

While the Declaration establishes many of the community's restrictions, the Rules and Regulations help explain how those restrictions, and many day-to-day community expectations, are carried out.

For many of your everyday questions, this is the document most likely to have the answer.

You don't have to learn everything today.
